Terms of Service

Terms governing your use of Public Safety Drone Ops software and services.

1. Acceptance of Terms

By accessing or using the Public Safety Drone Ops ("Public Safety Drone Ops," "we," "us," or "our") website at publicsafteydroneops.com, the Public Safety Drone Ops mobile application, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use our Services.

These Terms constitute a legally binding agreement between you and Public Safety Drone Ops We may update these Terms from time to time; continued use after changes constitutes acceptance.

2. Description of Services

Public Safety Drone Ops provides automated drone mission planning software, including:

  • Automated flight mission generation from addresses or polygons
  • WPML file generation for DJI enterprise drones
  • Fleet management and drone tracking
  • Photo upload and management
  • Mission history and reporting

3. Account Registration and Security

  • You must provide accurate, current, and complete information during registration
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must notify us immediately of any unauthorized access to your account
  • You are responsible for all activities that occur under your account
  • You must be at least 18 years old to create an account

4. Subscription Plans and Payment

4.1 Pricing

Subscription plans and pricing are displayed on our pricing page. Prices are subject to change with 30 days' notice to existing subscribers.

4.2 Billing

  • Subscriptions are billed monthly or annually, as selected during purchase
  • Payment is processed securely through Stripe
  • All fees are in US dollars and are non-refundable except as stated in Section 4.4
  • Failed payments may result in service suspension after a 7-day grace period

4.3 Free Trial

If offered, free trials provide full access for the specified period. You will not be charged until the trial ends. You may cancel at any time during the trial without charge.

4.4 Refund Policy

We offer a 30-day money-back guarantee on all new subscriptions. If you are not satisfied, contact us within 30 days of your initial purchase for a full refund. Renewals are non-refundable.

5. Acceptable Use

You agree NOT to:

  • Use the Services for any unlawful purpose or in violation of any applicable laws or regulations
  • Fly drones in violation of FAA regulations, local laws, or airspace restrictions
  • Share, resell, or redistribute your account access without authorization
  • Reverse-engineer, decompile, or disassemble any part of our software
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use the Services to transmit malware, viruses, or harmful code
  • Scrape, crawl, or harvest data from our Services without permission
  • Interfere with or disrupt the integrity or performance of the Services

6. Drone Operations Disclaimer

IMPORTANT: Public Safety Drone Ops provides mission planning tools only. You are solely responsible for:

  • Compliance with all FAA Part 107 rules (or applicable regulations in your jurisdiction)
  • Obtaining required Remote Pilot Certificates and waivers
  • Checking airspace restrictions (LAANC, TFRs, NOTAMs) before every flight
  • Performing pre-flight safety inspections of your equipment
  • Maintaining visual line of sight (VLOS) unless authorized otherwise
  • Safe operation of your drone at all times
  • Obtaining property owner permission for inspections

Public Safety Drone Ops does not guarantee the accuracy of building footprints, altitude calculations, or flight paths. Always verify mission parameters before flying.

7. Intellectual Property

7.1 Our IP

All content, software, algorithms, designs, trademarks, and other intellectual property in our Services are owned by Public Safety Drone Ops and protected by copyright, trademark, and other IP laws. You may not copy, modify, or distribute our IP without written permission.

7.2 Your Content

You retain ownership of photos, data, and content you upload through our Services. By uploading content, you grant Public Safety Drone Ops a limited license to process, store, and transmit that content solely for providing the Services to you.

8. Data and Privacy

Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using our Services, you consent to our data practices as described in the Privacy Policy.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Public Safety Drone Ops SHALL NOT be liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
  • We are not liable for damages resulting from drone operations, including property damage, personal injury, or regulatory violations
  • We are not liable for the accuracy of third-party data (building footprints, elevation data, weather data)

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, or that defects will be corrected. Mission plans are generated algorithmically and should always be reviewed before flight.

11. Indemnification

You agree to indemnify and hold harmless Public Safety Drone Ops, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Services
  • Your drone operations
  • Your violation of these Terms
  • Your violation of any third-party rights

12. Termination

  • By You: Cancel your subscription at any time through your account settings or by contacting us. Access continues until the end of your billing period.
  • By Us: We may suspend or terminate your account for violation of these Terms, with notice when practicable. In cases of fraud or security threats, we may act immediately.
  • Effect: Upon termination, your right to use the Services ceases. We may retain your data as required by law or for legitimate business purposes.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict of law provisions. Any disputes shall be resolved through binding arbitration in Dallas County, Texas, under the rules of the American Arbitration Association. You waive any right to participate in class action lawsuits.

14. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Public Safety Drone Ops regarding the Services and supersede all prior agreements.
